Prosecutors Desk 2-27-11

Three weeks ago a jury returned a verdict of guilty on one count of Trespassing and one count of Malicious Mischief against Mr. Dana Henry. The trial was the result of an incident last fall when Mr. Henry went onto the property of his neighbor and shot a large family dog.  The victims in the dog shooting case spoke to at the sentencing and told the judge about the impact that this shooting had on their family and their autistic son.  As a result of this incident and the loss of their child’s protector they moved from their residence to a new location that is more secure.  The defendant was represented by Rob Cossey of Spokane at the sentencing.  The judge sentenced Mr. Henry to 5 days in jail, 240 hours of community service and 24 months of probation.  In addition he was ordered to pay $2500 in restitution for the value of the animal he shot.  Mr. Henry expressed remorse for his actions at the sentencing hearing.

The State v. Clinton Glover case was scheduled to proceed to trial on Feb 15th.  The case was continued at the last minute because a witness for the defendant was unavailable.  The witness is in the state of Montana.  There is a special process that must be followed to obtain the presence of an out of state witness by subpoena.  The case is continued until the jury term in April.

Over the past two weeks both Christopher Forsyth and Devin Casey pleaded guilty to Possession of Stolen Property in the First Degree with Aggravating Circumstances.  Neither of these defendants had any criminal history whatsoever. The charges arouse out of an incident that occurred back in the summer months of last year.  They acquired containers from an elderly woman in Colville which contained her life savings of 18,000.  She lives on a meager fixed income, and had saved these amounts over the past 20 years.  Each boy pleaded guilty to Possession Stolen Property 1, with the Aggravating circumstance of a “major economic offense,” essentially, that it was greater amount of value than usual for this type of offense, or the impact on the victim was greater than usual for this type of offense.  The Standard Range for these offenses, with no criminal history was 0-90 days.  However, with these aggravating circumstances, each was sentenced to 6 months.
