I received another demand from We the People. (now 13) They demand that I file multiple criminal charges against Sheriff Kendle Allen. They did not make an appointment with me, but told the media they would be at my office at 10. I had a medical appointment at that time, but I found out they were coming, emailed them and asked them to give the demand to my deputy, Nick Force. I asked them for the courtesy of not filming Mr. Force. Despite my request, they secretly filmed the delivery to Mr. Force. Then they sent the video clip to KHQ with the idea that criminal charges had been filed against Kendle Allen. I called KHQ and told them what really happened and they took the video down from their website, but it was up for a two or three days. (Probably to the glee of those who did it)

This is another example of the tactic used by the folks who call themselves “We the People.” They mislead the public. This kind of conduct is nothing to be proud of and gives a bad name to other groups and people who are sincerely working to restore the course of our society. We the People only want attention. They damage the cause they claim to espouse. It is further evidence of the character and spirit behind this group of people.

They claim that Kendle Allen is not legally Sheriff. They ignore the fact of his election and claim he is not legally Sheriff, because his “Oath of Office” is not “recorded” with the Auditor, but is “filed” with the Auditor.

They claim that since he is not legally in office, all the things Kendle Allen has done as Sheriff, are illegal and criminal. They claim that his authorizing payroll, or signing arrest warrants, and acting like the Sheriff, should be the basis of criminal charges like perjury, signing false documents, impersonating an official, and such. They demanded I do something by this past Friday… Woops, I guess I missed another deadline.

There are several different definitions of the words “filed” and “recorded” depending on the context or as they used in different chapters of the RCWs. “We the People” use whichever definition suits them most, taking definitions from one chapter and using it in another context and chapter.

“We the People,” also refer to the law as “your RCWs.” This is further evidence of their mistaken and arrogant view that the law does not apply to them as individuals. They do not like to write about that when they print things in the paper. I would like to hear the argument behind that belief.

To find out what is required about the oaths, we contacted MRSC, the municipal resources service that advises cities and towns and counties. Our Auditor consulted his peers across the state, and at prosecutors meetings, and I inquired of the practices in other counties. To the best that I can find out, the Oaths of Office of Stevens County officials are filed with the Auditor same way that they are filed with Auditors all across the state.

The demand document cited old criminal statutes are not the law. It referred to court rules from 30 years ago for authority. Some of the signatures were altered by white out and written over !!!! ????

I did find something concerning. The document warns that the “people’s patience is wearing thin.” Is this a warning that a vigilante group is about to take action? Do they endorse or support acts of domestic lawlessness? They have talked about forming a “citizens grand jury” and charging folks with crimes. Do they think they can summons or arrest and punish people too? This kind of threatening talk and activity does not build up our community. It tears it down. I hope they do not do this.

Kendle Allen is the Sheriff because a majority of the voters last election voted him to be Sheriff. At that time, he was still under the Oath he took when he was appointed to replace Craig Thayer. Whether he had to retake the Oath or where or whether the Auditor files it or records it does not control whether he is the Sheriff. What a bunch of nonsense!

But wait, this is election time – the season of nonsense. Perhaps this whole business is about trying to get Kendle Allen’s opponent, Mr. Barker elected. Does Mr. Barker share the same extreme views as “We the People”? Surely no one would stoop so low as to try and influence public opinion by trying to get their opponent investigated or charged with a crime, would they? Well, I guess it depends on the kind of people they are. Some would.

I support Kendle Allen for Sheriff. He is the only candidate qualified with training, experience, competence and common sense. He should be re-elected.
