Prosecutors Desk 9-3-12

District Court is a busy court. There are two deputy prosecutors who handle cases there. The cases are misdemeanor and gross misdemeanor crimes with maximum sentences of 90 day for misdemeanors and 364 days for gross misdemeanors. DUI, simple assaults (many with domestic violence), theft, minors with alcohol and driving while suspended are the most common cases that come into District Court. I believe that at least 60% of the cases involve alcohol in one way or another.

During one day recently which was fairly typical, the following DUI cases were resolved:

Howard Justice pleaded guilty to DUI with a breath test under .15. He received a sentence of 2 days in jail and all the standard DUI fines and conditions. He had 1 prior DUI in 1996.

Carla Keely pleaded to DUI with a breath test of over .15. She received 2 days in jail and 24 hours community service plus the standard fines and conditions.

Eric Olson pleaded to DUI with a high BAC .29. He received 20 days and standard fines and conditions. He had priors outside of 7 years, and was returned to Grant County regarding a deferred DUI from 2002.

Ralph Simpson pleaded guilty to DUI. He received 2 days in jail and fines and conditions. This was an accident in winter weather conditions. He had a prior DUI which was amended to Reckless Endangerment in 94

Nigel Smith pleaded to DUI. He received 2 days in jail with 13 days work crew and fines and conditions. He had priors outside of 7 years. Tribal police and state patrol were involved in his arrest.

Jacob Level pleaded guilty to DUI. He received 120 days and fines and conditions. He had resisted arrest and threatened to kill the officer.

Eugene Jupp pleaded guilty to DUI and received 71 days. His history included multiple DUI outside of 7 years and a felony DUI out of Montana. He was transported back to Montana on a warrant to return to prison.
